2: Negotiations

in

These are between the claimant group and the Office of Treaty Settlements (OTS)

According to the OTS, claimant groups entering negotiations with the Crown need a mandate for their appointed negotiators.

  1. Terms of Negotiation - an agreement between both parties as to how negotiations will take place.
  2. An Agreement in Principle which broadly sets out the scope of the remedies for settling the claim.
  3. Deed of Settlement:  the precise details. The Deed generally includes an acknowledgment of the breaches of the Crown’s Treaty breaches, a return of culturally significant sites and  certain commercial assets, and a monetary payment.

All these milestones must have been discussed and approved by the claimant group as a whole. Postal ballot voting is the method of confirmation required by the Crown of the claimant group’s approval of the last two milestones.

Ngati Whatua o Kaipara ki te Tonga signed Terms of Negotiation in June 2008.
